Terms of Use for Navigation Updates

The Terms of Use of Navigation Updates (hereinafter referred to as “the Terms of Use”) specify the conditions of use of Navigation Updates (hereinafter “the Service”) provided by Hyundai Motor Group (hereinafter “the Company ).

Chapter 1. General Provisions

Article 1. Definition
The terms used in the Terms of Use shall have the meanings specified as follows:
(1) "User" refers to a general term for customers using the Service.
(2) "Personal Information" is defined as information about a living individual that can be used to identify that individual through what is contained in the information, such as name, date of birth, or other descriptions (including information that can be easily compared to others, allowing identifying one from another), and the details are determined by what is specified in the Personal Information Protection Act.

Article 2. Application of the Terms of Use
1. The Terms of Use are applicable to all relationships between the Company and the User concerning the use of the Service by the User and others.

1. The Company shall properly handle registration information, information obtained through the Service, website access information concerning the Service, and the personal information contained in the analysis data of the information obtained in this manner in accordance with the Personal Information Protection Act and other pertinent laws, the privacy policy of Navigation Updates, “Regarding Treatment of Personal Information” published in the Company’s website, and specific privacy policy that is applicable to the Service by the Company.
2. If the User fails to provide the Company with the requested personal information, then the Service may become inaccessible or restricted in whole or in part.

Chapter 3. Use of the Service, etc.

Article 4. Relevant Service
1. If the User uses the relevant Service provided by a third party, then the User must comply with both the Terms of Use and the terms of the third party. The Company assumes no liability for third-party services or information.
2. The Company may, by its sole discretion, add, modify, or delete all or portions of the Service without the User's consent.

Article 5. Copyright, etc.
1. The intellectual property rights to all of the content delivered through the Service, such as copyrights, trademarks, and design rights, are owned by the Company and other legitimate owners. The Company does not grant the User these intellectual property rights in any case unless explicitly granted by these Terms of Use or others.
2. The Company owns the copyrights to the User's suggestions, reviews, and other comments on the Company's Service, as well as all other rights. The User does not exercise moral rights to the Company or a third party designated by the Company regarding the relevant comments and others.

Article 6. Prohibited Activities
The User shall not engage in the following activities while using the Service and others:
(1) Activities such as copying, modifying, the public transmission (including making it transmittable), distributing, transferring, lending, translating, adapting, and so on that infringe on the intellectual property rights of the Company or other lawful owners;
(2) Activities that infringe on the Company's or a third party's property, rights, or privacy, and/or undermine the Company's or a third party's reputation or credibility;
(3) Activities that involve disassembling, decompiling, reverse engineering, or creating, transmitting, and/or recording secondary works or harmful computer programs, and others, or activities that have an impact on the security of the Service and/or impede its operation by applying unreasonable loads to the Service's network, and others;
(4) Violations of the rules of the domestic and international networks to which the User has access;
(5) Activities that may interrupt or have the potential to disrupt the Service's operation;
(6) Activities that exploit the Service for illegal or profiteering purposes;
(7) Violations of the law or established social values and good manners;
(8) Violations of the Terms of Service, and;
(9) Other activities deemed inappropriate by the Company.

Article 7. Suspension of the Service
When one of the following circumstances occurs, the Company may temporarily discontinue providing the Service without prior notice to the User:
(1) During a routine or emergency repair and maintenance of the system associated with the Service;
(2) When the Service is unable to be supplied due to incidents such as a fire or a power outage;
(3) When the Service is unable to be supplied due to a natural disaster such as an earthquake, volcanic activity, flood, or tsunami;
(4) When the Service is unable to be provided due to circumstances such as war, revolt, riot, labor dispute, and so on;
(5) When a communication service is terminated or communication failures occur due to causes other than the terminal usage environment, and;
(6) If the Company deems it necessary to temporarily suspend the Service due to operational or technical issues.

Article 8. Change or Termination of the Service
The Company may add, change, or discontinue all or portions of the Service and others without the User's prior approval. If this causes damage to the User, then the Company bears no liability in this event.

Article 9. Exclusion of Anti-social Forces
1. The User shall represent and pledges that they (if the User is a corporation, it may cover the CEO, executives, or a person who has substantive influence on management, and their employees) do not correspond now, nor will they correspond in the future, to any of the anti-social forces including an organized crime group, organized crime group member, associate members of an organized crime group, company affiliated with an organized crime group, corporate racketeer or the like, group engaging in criminal activities under the pretext of conducting a social campaign, group engaging in criminal activities under the pretext of conducting political activities, crime group specialized in intellectual crimes, or other person similar to the preceding items (hereinafter referred to as “Anti-social Forces”).
2. The User pledges not to directly or indirectly engage in any of the following:
(1) Violent acts of demand;
(2) Unjust acts of demand exceeding legal responsibility;
(3) Acts that use threatening behavior or violence in regard to transactions;
(4) Acts of circulating rumors and using fraud or power to damage HMG’s credibility or to interfere with HMG’s business; and
(5) Other acts similar to the preceding items.

Chapter 4. Responsibility

Article 10. Compensation for Damages
If the User causes damage to the Company or raises concerns about prospective damage to the Company by engaging in any violations of the Terms of Use or illegal activities, then the Company may restrict the User from engaging in the relevant activities and seek compensation.

Article 11. Indemnity
1. The Company shall not be held accountable for any damage or loss caused by the Service's defects, interruptions, functional failures, etc. Unless expressly stated in the Terms of Use, the Company accepts no responsibility for any implicit guarantee, any assurance of the quality, utility, or performance of the relevant Service and others, any assurance of computer, technology, or network performance, and/or any assurance of the accuracy of information provided in regard to the relevant service and others.
2. Except in the case of intent or gross negligence on the part of the Company, the Company shall not be held liable for any damage or loss suffered by the User as a result of their inability to use all or part of the relevant Service if it falls under any of the following:
(1) Despite the Company's reasonable safety control measures, a third party gained unauthorized access or infiltrated a computer virus; and;
(2) The provision of Service was interrupted, delayed, or impaired, or data loss occurred due to failures in communication channels, systems, or servers, and others.
3. The Company shall not be held liable for any disputes that may occur between the User and a third party (including but not limited to other users and affiliated businesses).

Chapter 5. Others

Article 12. Prohibition on the Transfer of Rights
The User shall not transfer their contractual status, or all or part of their rights or obligations to a third party as a means of succession or collateral.

Article 13. Method of Contact
Inquiries, consultations on the Service and others, and/or contact and/or notice by the User to the Company, and contact and/or notice by the Company to the User, shall be made through the appropriate channels.

Article 14. Amendment of the Terms of Use of the Service
1. The Company has the right to change the Terms of Service at any time by posting them on the Service or by other means deemed appropriate by the Company.
2. Unless the Company stipulates a specific date of entry into force, the change to the Terms of Use will take effect on the day announced after the modification or the day it is made available to the User, whichever is earliest.
3. If the User uses the Service or others after the effective date of the Terms of Use modification, then it is assumed that they agree to the Terms of Use. However, for any alteration that requires the User's approval by law, the Company must obtain the User's consent in some way.
